Terms and conditions of sales
1. General Provisions
Browsing and placing a purchase order on this site implies acceptance of the terms and data protection policies adopted by the site as indicated herein. Users are required, before accessing the products provided by the site, to read these terms of sale, which are generally considered accepted at the time of purchase.
2. Product Availability
Product availability refers to the time when the buyer places the order. This availability should be considered merely indicative because, due to the simultaneous presence of multiple users on the site, products may be sold to other customers before the order is confirmed. In such an event, the order will be rectified by removing the unavailable product, and the buyer will be informed via email. The customer can then request the cancellation of the order with a right to a refund of the amount paid or opt for the replacement of unavailable products with others in the catalog.
3. Purchase and Delivery Methods
Once the desired products have been selected, they will be added to the cart. Simply follow the purchase instructions, entering and verifying the requested information at each step of the process. Order details can be modified before payment. Delivery will be made to the address provided at the time of purchase. Delivery times range from 3 to 5 working days, except for any delays. To track an order, follow the instructions provided in the email received when the goods are taken over by the courier. If delivery is unsuccessful, the courier will make another attempt on the next working day. If delivery is still unsuccessful on the second attempt, the ordered goods will be held for five working days at the courier’s depot. In this case, any additional delivery request costs will be borne by the customer.
4. Payment Methods and Prices
The price of the products is as indicated on the site from time to time. Prices include VAT. Shipping is free for orders over €48. For orders under €48, the shipping cost is €20. The expenses are calculated automatically during the purchase process and explicitly highlighted at the time of order placement.

Payment can be made by:
– PayPal / Credit Card
– Bank transfer, indicating the order ID in the reason for payment
The company will not process the order until the payment has been confirmed.
5. Transfer of Risk
The risks relating to the products will pass to the buyer from the moment of delivery.
6. Warranty and Commercial Compliance
The seller is responsible for any defects in the products offered, including the non-conformity of the items to the products ordered, pursuant to Italian law.
7. Right of Withdrawal
In accordance with current legal provisions, the buyer has the right to withdraw from the purchase within 14 days under Art. 57 of Legislative Decree 206/2005, starting from the date of receipt of the products.
The customer wishing to exercise the right of withdrawal must notify FUNARO srl by email at info@funaro.it, providing the following information:
- Order number and date as indicated in the confirmation email.
- Specify which products the customer intends to return (identifying them with the article code).
- Specify the reasons for the return.
Our operators will respond as soon as possible. In case of damaged goods, we may request a photo via email with a description of the damage to prevent similar issues in the future.
Within and no later than 14 days from the communication of the intention to return, the customer must send the goods to be returned to the address:

To proceed with the return, the following conditions must be met:
The purchased product must be returned intact, in its original packaging, complete in all its parts. Upon arrival at Funaro srl, the product will be examined to assess any damage or tampering.
The right of withdrawal is reserved only for individuals, excluding purchases made by entities conducting transactions within their professional activities.
FUNARO SRL commits to refunding the amounts to the customer within 14 working days from receiving the returned products, using the same payment method chosen by the buyer during the purchase. The refund amount will equal the value of the returned products.
The cost of returning the products in case of withdrawal is borne by the customer.
8. Responsability
The Provider assumes no responsibility for disruptions due to force majeure events such as, by way of example, accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods, and similar events that prevent, in whole or in part, the execution of the contract within the agreed times.
The Provider will not be liable to any party or third parties for damages, losses, and costs incurred due to the non-execution of the contract for the reasons mentioned above, and the customer will only be entitled to a refund of the price paid.
The Provider is not responsible for any fraudulent or illegal use that may be made by third parties of credit cards or other means of payment when paying for the purchased products. At no time during the purchase process does the Provider have access to the customer’s credit card information, which is transmitted directly to the payment service manager without intermediaries and is automatically linked to the Provider’s site at the end of the procedure.
9. Personal Data Processing – Privacy Policy Art. 13 EU Regulation 679/2016
EU Regulation 679/2016, providing provisions for the protection of individuals and others concerning the processing of personal data, stipulates that the data subject (hereinafter also “subject”) must be informed in advance about the use of data concerning them and that the processing of personal data is allowed only with the express consent of the data subject except in cases provided by law. For this purpose, under and for the effects of Art. 13 of the aforementioned regulation, the data controllers’ details are as follows:

9.1. Purpose of Data Processing (Legal Basis).
Personal data are processed within the normal activity of e-commerce for the following purposes:
a) Compliance with obligations provided by laws, regulations, and community legislation as well as by provisions issued by authorities legitimized by law or supervisory and control bodies;
b) Establishment and management of relationships with customers for operational, managerial, administrative, and accounting needs, including sending commercial invoices by email (in execution of legal obligations, particularly in tax matters);
c) Sending commercial and advertising communications (also via automated sending methods);

e) Profiling for personalized customer management: Collection of customer’s personal data studied based on habits and consumption tendencies. With your consent, the data may be used for customer profiling, information and promotional purposes of own or third-party products and/or services, as well as surveys on the satisfaction about the quality of those already received and market research via email and SMS.
The provision of data for contractual purposes as per points a), b) is mandatory (without it, it is not possible to proceed with the sales contract and the provision of related services).

In any case, all these data are processed in compliance with the law and the confidentiality obligations that inspire the company’s activities.
For the purposes mentioned above, your data will be kept for the period required by law.
9.3. Mandatory or Optional Nature of Data Provision
The provision of data is optional, but the lack of such provision will make it impossible for FUNARO S.R.L to establish any commercial relationships.
Any partial or total refusal to respond by the subject could make it impossible for FUNARO S.R.L to perform the service activities requested.
9.4. Categories of Subjects to Whom the Data May Be Communicated
Personal data held by FUNARO S.R.L. may be communicated to:
a. Public and private entities whose communication and/or consultation result from legal provisions;

c. Companies and public entities whose communication is closely related to the company’s purposes and the execution of the sales contract;
Personal data processed by the company are not subject to dissemination and will not be transferred outside the EU.
9.5. Rights of Access to Personal Data and Other Rights
The Regulation grants the data subjects the exercise of specific rights (Art. 15 GDPR). In particular, the data subject can obtain from the Data Controller the confirmation of the existence or non-existence of their personal data and their communication in an intelligible form.
The data subject has the right to rectification (Art. 16) and erasure of the data (“right to be forgotten”) (Art. 17). The data will be processed until the conclusion of the contractual relationship. The rights in question can be exercised, even through an appointed representative, by making a request to the Data Controller at the following email address: privacy@funaro.it.
The data subject also has the right to lodge a complaint with the Data Protection Authority at the email address garante@gpdp.it or protocollo@pec.gpdp.it.
FUNARO S.R.L commits to ensuring the effective exercise of the data subject’s rights, adopting suitable measures aimed at facilitating access to personal data by the data subject and simplifying the method and reducing the response times to the requester.

11. Applicable Law and Jurisdiction
These terms and conditions of sale are governed by Italian law.
Any disputes relating to and/or consequent to these terms will be exclusively resolved by the Italian judicial authority. In particular, if the buyer qualifies as a consumer, any disputes must be resolved by the court of the place of domicile or residence of the same according to the applicable law.
